SUBDIVISION COMMITTEE
: The Subdivision Committee will meet earlier the same day at 2:30 p.m. in Room 704 to consider [S-28-01] Preliminary Subdivision Plan for Hampton Meadows and [S-30-01] Preliminary Subdivision Plan for The Park At Langston Cluster recommended for denial by Subdivision Administration.

The are limited to preliminary subdivision plans recommended for approval by the Subdivision Administrator and not involving a variance, and items where a Planning Board committee unanimously recommends approval and concurs with the staff recommendation. If any Board member objects to unanimous consent approval of any item below (whether because of disagreement with the recommendation or a wish to discuss the matter further), the Chair will declare the item removed to an appropriate place on the agenda for separate discussion.]
a. [S-27-01] Preliminary Subdivision Plan for Mount Pleasant Woods:
Proposal to subdivide an 11.702 acre parcel, zoned R-40W, into 6 lots, located on the north side of Old Creedmoor Road, east of its intersection with Boyce Mill Road. The plan also proposes a .5 acre recombination with the Woodlief property to the northwest. Staff recommends approval subject to the following condition.
1. Dedicate 5 feet of additional right-of-way along Old Creedmoor Road, a major thoroughfare, adjust lot sizes as needed to meet minimum lot area.
b. [S-29-01] Preliminary Subdivision Plan for Covington Cluster (formerly submitted as Optimist Farm Cluster S-33-99):
(This subdivision was previously approved by the Planning Board on September 1, 1999 as a cluster subdivision with community water and individual septic systems. The reason the plan has been resubmitted is the change in utilites, road design and increase in the number of lots.) Proposal to subdivide a 52.67 acre parcel, zoned R-30, situated north of Optimist Farm Road between West Lake Road and Bells Lake Road and south of the proposed Southern Wake Expressway into 76 lots as a cluster subdivision. Staff recommends approval subject to the following conditions.
1. Alignment of roads should be confirmed with adjoining subdivisions prior to construction plan approval; and
2. Subdivision name should be approved by Administrative Assistant.
4. Rezonings -
[These are petitions to amend the County's Zoning Map to reclassify land from one zoning district to another, thus subjecting the site to a different set of zoning regulations. The Planning Board reviews these petitions in an advisory capacity, recommending that the Board of Commissioners either approve or deny the petition. The Board must base its recommendation on whether or not the proposed rezoning is consistent with the County's Land Use Plan and otherwise advances the public health, safety, and general welfare.]
a. [ZP-805-01] East side of Forestville Road:
Request to rezone 10.1 acres from Residential-30 to Conditional Use-Highway District, located on the northeast side of Forestville Road, a major thoroughfare, about 0.3 miles north of its intersection with Lillie Liles Road.

5. Preliminary Subdivision Plans (including associated variances) -
[These are applications for approval of preliminary plans for the division of land into lots, which are reviewed for compliance with standards set forth in the County's Subdivision Ordinance. If the plan complies with all applicable standards, the Board must approve it; if not, the Board must either deny it or approve it with conditions specifying actions that will ensure such compliance. These applications may be accompanied by applications for hardship variances from the Subdivision Ordinance's standards, which must be decided before review of the preliminary subdivision plan. The Planning Board may grant a variance only after it hears evidence as to hardships due to the land or parcel, makes findings of fact supported by the presented evidence, and, based on those findings of fact, concludes that: (a) strict application of the relevant standard would prohibit subdivision of the parcel in accord with the spirit and intent of the Subdivision Ordinance because of extraordinary circumstances peculiar to the parcel; (b) the variance is necessary to avoid extraordinary and unnecessary hardship; and (c) the variance will not result in detriment to the public interest or violate the intent and purpose of the Subdivision Ordinance. The applicant bears the burden of presenting sufficient evidence to allow the Board to make findings of fact and reach the required conclusions.]
a. [S-26-01] Hardship Variance and Preliminary Subdivision Plan for Hunters Cove:
Request a hardship variance from the Subdivision Regulation's 900-foot maximum cul-de-sac length requirement and proposal to subdivide a 24.7 acre parcel, zoned R-80W, situated on the west side of Lake Wheeler Road, between Penny road and Lake Wheeler into 9 lots. This is located south of the existing Enchanted Oaks Subdivision and west of the Lake Wheeler Park.
